ST JAMES, Jamaica - The proprietor of an auto-import company, who was accused of accepting $1.7 million from another individual for the acquisition of a vehicle that was never delivered, has now made full restitution payment.

Thirty-two-year-old Fitzroy Rowe of Grove Mount, Manchester was charged with obtaining money by means of false pretence.

The case came up for mention before presiding judge Natiesha Fairclough-Hylton at the St James Parish Court on Thursday.

On a previous mention date, Rowe's lawyer, Sherneika Jackson, explained that her client had received the money to purchase the vehicle overseas and that it was at the wharf. However, due to a delay in clearance, the vehicle was put up for auction.

As a result, the parties were referred to mediation to try to resolve the situation, and Rowe began making restitution payments.

During Thursday's sitting, the court was informed that Rowe had made full restitution payment, and the prosecution offered no further evidence against him.

"You are a businessman and you have to be careful of your business dealings," Fairclough-Hylton said to Rowe before discharging him.

According to the allegations, the complainant entered into an agreement with Rowe on December 22, 2022 for Rowe to purchase a 2013 Toyota Noah on his behalf.

The vehicle was never delivered and the complainant requested a refund, which was not granted.

Subsequent attempts to contact the accused were unsuccessful. However, the complainant later received words that Rowe had been arrested.
